EA Settles Engineer Class Action Lawsuit on Overtime Compensation

Electronic Arts today announced a settlement on overtime wages for current and former programmers of its California studios. Under the agreement, claims will be dismissed, and EA will make a $14.9 million payment to cover claims by the class members, plaintiffs' attorney fees, incentive payments, and administrative costs.

Eligible class members will receive notice and a claim form from the settlement administrator. Any portion of the settlement fund that is unclaimed by class members will be go to the Ronald McDonald House Charities and to establish scholarships at five selected universities for female and under-represented minority students interested in studying interactive entertainment. The five universities are Carnegie Mellon University, Cornell University, Georgia Tech, Stanford University, and Morehouse/Spelman College.

Settlement of the case, which is pending in the Superior Court of San Mateo County, California, must be approved by the Court before it becomes effective.

EA does not expect the settlement to have a significant impact on its fiscal fourth quarter 2006 financial results.
