Hot on the heels of 3D Realms' sudden shutdown last week, Take-Two has sued 3D Realms for failing to deliver Duke Nukem Forever. The associated case documents reveal that Take-Two is suing for the source code and has filed a restraining order to ensure that the code and assets remain secure and "unharmed" before the case goes to trial. Scott Miller, co-founder of 3D Realms, has shot down the rumor that Take-Two offered to buy the Duke Nukem IP for the reported $30 million.
