'Deep Black' (ALL) Publisher Dispute Continues, Restraining Order Issued

Deep Black combines action-packed battles with an immersive story line, of complex science-fiction mystery, espionage and bio-terror. Offering realistic physics in an underwater environment brings new “depths” to in-game challenges in Deep Black.

Deep Black is driven by a thrilling story. As leader of a deep sea elite force the player will compete against ruthless bioterrorists who are planning and carrying out their activities from the ocean floor. In comprehensive missions the goal is to infiltrate hidden subaqueous bases and to battle against mighty enemies using modern high-tech equipment. At the same time Deep Black keeps an ideal balance between underwater action and terrain fights. As the mission design will attach the same level of significance to both settings, a huge variety is guaranteed.

Deep Black is affected by total freedom in action, tactical fights, special weapon modes and brilliantly designed environments. As leader of the counter terrorist unit the player will definitely never get bored. During the single player campaign he fights his way through 30 extensive levels in a science-fiction world, characterized by terror, chaos, spying and the battle for world supremacy. Different opponents cross his path: whether drones, submarines, cyborgs, giant robots or human opponents – three levels of difficulty will keep both first-time users and advanced shooter experts on their toes.

BIART´s underwater engine guarantees unique and realistic effects like undulation, water distortion and dynamic light play. Outstanding graphics and fully 3D Vision technology supported by Nvidia create a harmonious atmosphere that can also be enjoyed in stereoscopic 3D.

In Sept. 2011 Strategy First signed an agreement with Just A Game to bring Deep Black to North American retail stores, but according to the developer, Biart, the German based publisher does not have any rights to the game. As the dispute continues Just A Game has issued a statement that it refused the allegations from Biart, and that is has received a "restraining" order against the developer.

Just A Game GmbH (“JAG”) announces that it has taken legal action sanctioned by the order of the Regional Court of Berlin against Biart Studio LLC (“Biart”). JAG has obtained a restraining order against Biart and with this legal procedure the German based publisher counters the recent assertion made by the Managing Director of Biart, Mr.Konstantin Popov regarding the publishing rights of ‘Deep Black’ (PC).

The Regional Court of Berlin acknowledges that the statements made by the developer against JAG and their strategic partners are damaging to the company’s business and reputation.

Along with the disparaging public remarks, the developer, Biart are in breach of their contractual obligations to JAG. The injunction made and sanctioned by the Regional Court prohibits Biart and its Managing Director Mr. Konstantin Popov from publicly disparaging JAG and their strategic partners, and from publicly denying the publishing rights of “Deep Black” (PC). Failure to comply will result in substantial fines, up to a detention order.

JAG is the licensed world wide publisher (Excluding CIS states of former Soviet Union) of the PC software title “Deep Black” and has sub-licensed the title for the North American Territory and worldwide digital distribution on Steam to publisher Strategy First Inc.

“The decision made by the Regional Court was expected and we want to make the situation transparent for all involved parties” comments Peer Fischer, Director of Legal & Business Affairs at JAG on the legal injunction. “The decision is to be understood that the developer is to meet its contractual obligations and provide open and direct communication with Just A Game”
