Bethesda 'Fallout' Preliminary Injunction Against Interplay Tossed Out

by Rainier on Oct. 28, 2009 @ 12:29 p.m. PDT | Filed under News

Last month, Bethesda filed suit against Interplay for their inability to move forward with the Fallout MMO, making digital distribution deals with GOG and Steam for its back catalog and repackaging products that have not been approved by Bethesda. It seems the preliminary injunction has been denied for various reasons, one being the complex language of the contract (e.g., the MMO required a $30M budget, but does not require Interplay to have spent it all).

Bethesda Files 'Fallout' Lawsuit Against Interplay

by Rainier on Sept. 12, 2009 @ 6:48 a.m. PDT | Filed under News

A Fallout MMO has been talked about since 2004, but Interplay was forced to sell off most of its licenses due to financial reasons. When Bethesda acquired the Fallout license, Interplay kept an exclusive Fallout MMO license, under certain conditions. Interplay's annual 10-K filing reveals that Bethesda might be trying to cash in on that, claiming that those "certain conditions," namely full production within 2 years and funding, have not been met, which would revert the MMO license back to Bethesda. Now it seems the Fallout 3 developer is following through as it has formally filed suit against Interplay for their inability to move forward with the MMO, but also for making digital distribution deals with GOG and Steam for its back catalog and repackaged products which have not been approved by Bethesda (thanks NMA).

by Rainier on Dec. 11, 2006 @ 11:03 p.m. PST | Filed under News

A recent SEC filing offers the first sign of live in quite a while from once famed publisher/developer Interplay, apparently getting ready to start production on a Fallout MMOG in January 2007 (thanks Blues). Set in the highly recognized Fallout post Nuclear Apocalyptic world giving consumers an ongoing virtual experience of today's life as if the cold war, which lasted for the best part of the second half of last century, had led to a nuclear disaster. The development budget is set for $75 million dollar and is scheduled to last until 2010, indicating approx when we should expect it in stores. Time will tell ...

Titus Interactive & Interplay Are No More...

by Judy on Jan. 5, 2005 @ 1:49 p.m. PST | Filed under News

Reuters France is reporting that the commercial court of Meaux announced on Monday that French publisher Titus and its subsidiary companies, Sofra Jeux (publisher) and Avalon France (previously known as Virgin Interactive) are bankrupt. Titus also held 62.25% of the Interplay shares, which is now also liquidated (thanks DuckforCover). Interplay recently signed a publishing deal with Majorem for its MMORTS Ballerium, so it is uncertain what will happen to the title now. Majorem had this to say : "We're still waiting for a confirmation of this item as posted by you, however in the meantime I can reassure that even in the case that Interplay liquidates as well, Ballerium is as safe as it was (or, as unsafe as it was, depending your point of view)."

More 'Interplay' Woes

by Rainier on April 15, 2004 @ 10:06 p.m. PDT | Filed under News

After yesterday's somewhat upbeat message by means of their financial results and revelation of various new titles, it seems all is not well over at Interplay. An article on Gamespot seems to indicate that Interplay is 3 months behind on the rent for their Irvine facilities and are facing eviction if they dont come up with roughly $450,000 in change. Although by now the eviction has expired and since Interplay is still on location, that would indicate something has been resolved.

'Interplay' Financial Result Reveals 'Fallout 3' And Several Others

by Rainier on April 14, 2004 @ 2:59 p.m. PDT | Filed under News

Today Interplay released its 4th quater 2003 results and apart from the usual digits & numbers (Interplay seems to be doing better, but still has financial hurdles to overcome) the real interesting bits came during the conference call disclosing several new titles. The fact that Interplay wants to focus on console titles is no surprise, neverthless KingPin 2 is in the works, but also new titles in the long running Decent & EarthWorms Jim franchise. Most important of all, an external studio is working on Fallout 3 (although not set in the typical D&D universe due to the Atari/Interplay dispute).
