Scheduled to launch in Japan next month already (Nov. 21) the new handheld sports a 4.2 inch screen (a 93% increase over the old version), and will retail for ¥20,000 ($220 USD).

It seems the preliminary injunction has been denied for various reasons, one being the complex language of the contract (e.g., the MMO required a $30M budget, but does not require Interplay to have spent it all).
